Movie Producer, Insurer Settle Lawsuit Over ‘Expendables’ Delays

A settlement has been reached between a movie production company and an insurer over filming delays during “The Expendables” involving stars Jason Statham and Sylvester Stallone.
Alta Vista Productions filed a lawsuit in Louisiana federal court more than a year ago alleging St. Paul Fire & Marine Insurance breached contracts that Alta Vista obtained to cover losses incurred due to delays in production of the movie—delays that were due to medical conditions suffered by Statham and Stallone.
St. Paul Fire & Marine issued a “motion picture production package” insurance policy to Alta Vista, according to court records.
Terms of the settlement were not disclosed in court documents.
According to the lawsuit, Statham had to miss time and delayed production on two occasions due to a growth on his vocal cord found after he underwent a medical exam as part of the insurer’s review to write the coverage. The growth had to be removed and follow-up treatments were required.
Production of the movie was delayed at its two locations—Rio De Janeiro, Brazil and New Orleans, La.
Stallone suffered an ankle injury while filming “The Expendables,” which also starred Jet Li, Mickey Rourke and Dolph Lundgren.
Alta Vista says it suffered more than $2.1 million in losses from the delays related to Statham and more than $306,000 in losses from delays due to Stallone’s ankle injury.
The production company says it received partial payments from Travelers of about $529,000 and $139,440 for the respective delays.
According to court documents, St. Paul Fire & Marine says it paid Alta Vista amounts owed under the terms of the policy and the proofs of loss presented to the insurer.
FV: How did The Expendables come about?
DC: Pretty much then. When I booked the job for Doom, Warners booked me into a two picture blind deal, which is, “Doom is the first one and then you’re going to write another movie for us later.” I had walked into a general meeting with a producer on the Warner’s lot, and pitched him this idea for The Expendables and he liked it.
FV: This was when you were writing Doom or after?
DC: This was a couple years after I had written Doom. I wrote [Doom] in like 2003. Movie came out in 2005, so somewhere around then, just before the movie came out. So we took it to Warners and I pitched it to my executive. On a blind deal you report to an executive. Mine was Greg Silverman, who’s now very high up at the studio. I pitched it to him. He bought it as my blind deal and then sent me off to write it.
It didn’t go anywhere at Warner Bros. It’s a war movie and the Warner’s regime at the time was very focused on Harry Potter and the family-friendly stuff. It sat there for a couple of years. Several years later Stallone’s agent was looking for material at the time and an executive at Warner Bros. sent it to Sylvester Stallone to see if he was interested in starring in it. They sent him my script; he said “I love it.” Some things happened, he rewrote the script, and he shot the movie. I never touched it again after that.
The Expendables Extended Director's Cut includes 11 additional minutes over the theatrical cut. It also includes a newly recorded introduction by its writer, director and star Sylvester Stallone; a featurette on Stallone and his directing career; 'Inferno,' a feature-length behind-the-scenes documentary that provides a unique perspective on the filmmaking process from Stallone's distinctive point of view; Spike TV program 'Action: The Expendables;' and a Sully Erna of Godsmack music video. A digital copy will also be included.
