I think Chan is out (which he says a couple months back, he's not available and also apparently he wants star in a movie with Sly only), Seagal possibly so (which was expected given his ego is probably bigger than all the cast egos combined). That said and as we've seen happen during the EX2 pre-production as well, the producers and cast can't be expected to to mention every single member of the cast every time. (I even suspect sometime some of the producers and actors get lost as to whom is in the movie and who's not) Also some can be in negociation
until the last minute (I hear some cast members may still be announced)...
Someone on the Stallone forum reminded me of this great quote of his at the time of EX2 which is a very representative rule of everyday filmmaking:
